RE: The tariff classification of a lap top computer bag and a carrying bag from China and/or Taiwan.

Dear Mr. Hung:

In your letter dated July 31, 1996, you requested a classification ruling for a lap top computer bag and carrying bag.

You have submitted photos of two items with your request identified as a lap top computer bag and a laundry bag. The computer carrying bag is said to be constructed of a tapestry fabric composed of 60 percent cotton and 40 percent polyester. The bag measures approximately 13" x 10 1/4" x 3". Based on the photo submitted, the item described as a laundry bag appears to be a carrying bag designed for travel and will be classified accordingly. The item is said to be composed of nylon with PVC backing. It measures approximately 16" x 12" x 22 1/2". You have also requested a classification for the lap top computer bag if composed of PU leather (fake leather), PVC sponge leather (fake leather) and check nylon.

The applicable subheading for the lap top computer bag composed of 60 percent cotton and 40 percent polyester will be 4202.92.6090, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcases, camera cases and similar containers, with outer surface of textile materials, other, of cotton, other. The duty rate will be 7 percent ad valorem.

The applicable subheading for the lap top computer bag if composed of nylon will be 4202.92.9025, HTS, which provides for trunks, suitcases, camera cases and similar containers, with outer surface of textile materials, other, other, of man-made fibers. The duty rate will be 19.5 percent ad valorem.

The applicable subheading for the lap top computer bag if composed of PU leather (plastic) and PVC (fake leather) will be 4202.92.9040, HTS, which provides for trunks, suitcases, camera cases and similar containers, with outer surface of sheeting of plastic, other, other, other. The duty rate will be 19.5 percent ad valorem.

The applicable subheading for the carrying bag of nylon will be 4202.92.3030, HTS, which provides for travel, sports and similar bags, with outer surface of textile materials, other, of man-made fibers, other. The duty rate will be 19.5 percent ad valorem.

Items classifiable under 4202.92.6090 falls within textile category designation 369. Based upon international textile trade agreements products of China and Taiwan are subject to quota and the requirement of a visa.

Items classifiable under 4202.92.9025 and 4202.92.3030 falls within textile category designation 670. Based upon international textile trade agreements products of China and Taiwan are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
