RE: The tariff classification of a women's blouse and cropped blouse from India

Dear Mr. Balsiger:

In your letter dated June 27, 1996 you requested a tariff classification ruling.

The submitted samples, styles 995-427 and 342-W1 are women's garments which are manufactured from 100% cotton woven fabric. Style 995-427 is a women's blouse and features a full front opening secured by a zipper, a front and back yoke, two button and flap chest pockets, a simulated button and tab at each side and long sleeves with cuffs. The fabric from which this blouse is made has two or more colors in the warp and fill.

Style 342-W1 is a sleeveless garment and does not reach the waist all around. This garment features a full front opening secured by a zipper, a shirt collar and a welt pocket at the chest.

As requested, your samples will be returned to you.

The applicable subheading for style 995-427 will be 6206.30.3010, Harmonized Tariff Schedule of the United States (HTS), which provides for women's cotton blouses with two or more colors in the warp and/or the fill. The rate of duty will be 16.2%.

The applicable subheading for style 342-W1 will be 6211.42.0081, HTS, which provides for women's other cotton garments, other. The rate of duty will be 8.5%.

Style 995-427 falls within textile category designation 341. Style 342-W1 falls within textile category designation 359. Based upon international textile trade agreements, products of India are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
