RE: The tariff classification of a steel cookware set from Taiwan

Dear Mr. Shoule:

In your letter dated June 14, 1994, on behalf of F.W. Woolworth Company, you requested a tariff classification ruling. The merchandise is item no. HC0013G, a seven-piece, green, steel cookware set. The set contains a 5 quart dutch oven, a 2 quart sauce pan, a 1.5 quart sauce pan, and a 9.5 inch fry pan. Three glass lids are included. The cookware has a non-stick interior and exterior finish. Analysis by the New York Customs Laboratory indicates that the finish is not composed of porcelain.

The applicable subheading for the cookware set will be 7323.99.7000, Harmonized Tariff Schedule of the United States (HTS), which provides for table, kitchen or other household articles, of iron or steel, other, other, not coated or plated with precious metal, other, cookingware. The rate of duty will be 5.3 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.

Sincerely,

Jean F. Maguire
Area Director
