RE: The tariff classification of surface decorated paper from England.

Dear Mr. Fondacaro:

In your letter dated April 5, 1994, on behalf of your client, Esselte Letraset, you requested a tariff classification ruling. A sample sheet of paper was submitted, along with certain specifications, which have been relied upon. The sample is designated #111 Mat Backing Paper, gray in color. It is made from 100 percent bleached sulphate pulp, weighs about 74 grams pr square meter (50 lbs/25 x 38-500), and is surface decorated on one face. No coatings were indicated or specified, and roll width may vary as specified on each purchase order.

The applicable subheading for the paper described, when imported on rolls of a width exceeding 15 cm, will be 4811.90.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for :Paper...surface-colored, surface-decorated or printed...in rolls or sheets: Other (than certain enumerated kinds): Weighing over 30 grams per square meter. The rate of duty will be 2 per cent.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
