RE: The tariff classification of an airbag component from Japan

Dear Mr. Zima:

In your letter dated January 11, 1994, on behalf of Taiyo Technology of America, Ltd., Arlington Heights, IL, you requested a tariff classification ruling. You have submitted a copy of an engineering drawing.

The imported product is a perforated stainless steel screen which is stated to be an integral part of an automobile airbag. Upon impact, an explosive device is used to inflate the airbag. The airbag screen is used to prevent particles from the explosive device from passing through the bag and injuring the passenger. These screens are stamped to shape and imported in coils. The end user needs only to separate each piece on the assembly line. The thickness of the sheets will vary from .2 to .6 millimeters. The width of the coils is 5 inches. The length of each coil may vary depending on the size ordered.

The applicable subheading for the airbag screen will be 8708.99.8080, Harmonized Tariff Schedule of the United States (HTS), which provides for other parts and accessories of motor vehicles of headings 8701 to 8705. The rate of duty will be 3.1 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
