RE: The tariff classification of men's garments, from Turkey.

Dear Ms. Webster:

In your letter dated January 17, 1994, you requested a tariff classification ruling.

Two samples have been submitted. Style N1-3024 is a man's shirt manufactured from a finely knit fabric composed of 100 percent cotton. The outer surface of the shirt is constructed with more than ten stitches per linear centimeter measured in each direction. The garment features a henley collar with a two button closure, short sleeves with rib-knit sleeve ends and one patch pocket above the waist. Also featured are side slits, a hanger loop and a hemmed bottom.

Style N1-3025 is a pair of men's shorts manufactured from a knit fabric composed of 100 percent cotton. The shorts feature a fly front with a one button closure, an elastic waist, a patch pocket at the rear and hemmed bottoms.

The applicable subheading for the shirt will be 6105.10.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for men's... shirts, knitted..., of cotton... The rate of duty will be 21 percent ad valorem.

The applicable subheading for the shorts will be 6103.42.1050, Harmonized Tariff Schedule of the United States (HTS), which provides for men's... shorts... knitted... of cotton... The rate of duty will be 17.1 percent ad valorem. Style N1-3024 falls within textile category designation 338. Style N1-3025 falls within textile category designation 347. Based upon international textile trade agreements, products of Turkey are subject to visa requirements and quota restraints.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U. S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
