RE: The tariff classification of Isoflurane (CAS 26675-46-7), put up in measured doses, from the United Kingdom

Dear Mr. Schraub:

In your letter dated September 23, 1992, resubmitted on November 4, 1992, on behalf of your client, Pitman-Moore, Inc., you requested a tariff classification ruling.

The subject merchandise, Isoflurane (1-chloro-2,2,2-trifluoroethyl difluoromethyl ether), is an inhalation anesthetic for veterinary use in horses. You state that the Isoflurane is made in the United Kingdom and shipped to Ireland, where it is " packaged dosage size" (100 ml per glass bottle) for export to the United States.

The applicable subheading for this product will be 3004.90.6003, Harmonized Tariff Schedule of the United States (HTS), which provides for medicaments ... consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses or in forms or packing for retail sale: other: other: for veterinary use. The rate of duty will be 6.3 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
