RE: The tariff classification of Optron 3D 35mm photographic cameras from West Germany.

Dear Mr. Leonard:

In your recent letter, you requested a tariff classification ruling. Your request was received in our New York office on August 2, 1990.

The Optron 3D Camera is a 35mm stereo reflex camera with automatic electric exposure control with a focus plane shutter and for use with interchangeable lens. The camera is used to take stereo (three-dimensional) photographs. The Optron 3D Camera is made by taking two Ricoh 35mm cameras, cutting them approximately in half and then rejoining them (using specially made parts) with both shutters working to 1/1000 of a second synchronization. (The principle of stereo photography is to take two photographs from a slightly different perspective. The Optron 3D Camera allows for the use of different focal length lens and for taking action stereo photographs.) The supplier is Peter Kato, in Dusseldorf, West Germany.

The applicable subheading for the Optron 3D 35mm Camera will be 9006.51.0040, Harmonized Tariff Schedule of the United States (HTS), which provides for other photographic (other than cinematographic) cameras: with through-the-lens viewfinder (single lens reflex (SLR) ); for roll film of a width of 35mm. The rate of duty will be 3 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
