RE: The tariff classification of women's blouses and shorts from the Philippines

Dear San Juan:

In your letter dated May 23, 1995, you requested a classification ruling. The samples submitted with your request will be returned to you under separate cover.

BATIK SHIRT #1 is a pullover blouse constructed from 100 percent cotton woven fabric. The blouse features a round neckline, a partial front opening secured by two buttons and short sleeves. The blouse also has one chest pocket and two 4 1/4 inch side vents.

BATIK SHIRT #5 is a sleeveless blouse constructed from 100 percent cotton woven fabric. The blouse features a round neckline and a full front opening secured by four buttons.

BARONG BLOUSE #1 is a blouse constructed from 100 percent cotton woven fabric. The blouse features short sleeves, a collar, a full front opening secured by four buttons and two 5 1/4 inch side vents.

BARONG BLOUSE #2 is a blouse constructed from 80 percent polyester/20 percent cotton woven fabric. The blouse features short sleeves with embroidery, a full front opening secured by four buttons and two 6 inch side vents. The blouse has embroidery around the neck, across the upper back and the upper front bodice.

BATIK SHORT #2 is a pair of short constructed from 100 percent woven cotton fabric. The shorts feature an elasticized back waist, a front button and zipper closure and one rightside front pocket. The shorts also has five belt loops and cuffed leg openings.

The applicable subheading for BATIK SHIRT #1, BATIK SHIRT #5 and BARONG BLOUSE #1 will be 6206.30.3040, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' blouses, shirts and shirt-blouses: of cotton: other: other: women's. The duty rate will be 16.3 percent ad valorem.

The applicable subheading for BARONG BLOUSE #2 will be 6206.40.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' blouses, shirts and shirt-blouses: of man-made fibers: other: other: women's. The duty rate will be 28.4 percent ad valorem.

The applicable subheading for BATIK SHORT #2 will be 6204.62.4055, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear) of cotton: other:other: shorts: women's. The duty rate will be 17.6 percent ad valorem.

BATIK SHIRT #1, BATIK SHIRT #5 and BARONG BLOUSE #1 fall within textile category designation 341; BARONG BLOUSE #2 falls within textile category 641 and BATIK SHORT #2 falls within textile category 348. Based upon international textile trade agreements products of the Philippines are subject to a visa requirement and quota restraints.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
