RE: The tariff classification of women's woven wearing apparel from China

Dear Mr. Adams:

In your letter dated January 9, 1995, you requested a classification ruling. The samples submitted with your request will be returned to you under separate cover.

All of the samples submitted are constructed from woven fabric that is 55 percent ramie and 45 percent cotton.

Style 9008 consists of a blouse and a pair of shorts. The blouse features short sleeves, self covered shoulder pads, a collar and a full front opening secured by three self covered buttons. The collar and the sleeves are sheer and are of 100 percent woven polyester. The sleeves have an appliqued design with beading and braiding and are banded with contrasting colored fabric. The collar has appliques of colored fabric strips and is banded with fabric. The shorts feature a waistband, elasticized in the back, a rear button and zipper closure and two side seam pockets.

Style SBS-243-95 consists of a jacket and a pair of shorts. The jacket features long sleeves, a collar, self covered shoulder pads and a full, side front zipper closure. The jacket has beading on the body, sleeves and collar and nailhead designs on the collar points, lapels and sleeves. The shorts feature and elasticized rear waistband, a side button and zipper closure and two side seam pockets.

Style SBR-18-95 is a suit consisting of a jacket and skirt. The unlined jacket features self covered shoulder pads, a round neckline, long sleeves and a full front opening secured by five self covered buttons. The jacket also has an embroidered cutout design with beading an the lower sleeve edges and lower front panels. The unlined skirt features an elasticized rear waistband,
a rear button and zipper closure, two side seam pockets , a rear center slit and a repeat of the embroidered cutout design on the lower right front panel.

Style SBS-180-95 consists of a blouse and skirt. The peplum-styled blouse features a shawl collar, long sheer sleeves with a two button cuff, an insert that buttons in and extends to the waist and a full front opening that is secured by a button and loop closure. The sleeves are constructed from 100 percent woven polyester. The blouse has beads sewn into the seam around the collar, down the front opening and around the bottom. The sleeves have a lace applique and beading design and the cuffs are of the ramie/cotton fabric. The unlined skirt features an elasticized rear waistband, two side seam pockets, a back button and zipper closure and a rear center slit.

The applicable subheading for the blouses of styles 9008 and SBS-180-95 will be 6206.90.0040, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' blouses, shirts and shirt-blouses: of other textile materials: other. The duty rate will be 7.1 percent ad valorem.

The applicable subheading for the shorts of styles SBS-243-95 and 9008 will be 6204.69.6050, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): trousers, bib and brace overalls, breeches and shorts: of other textile materials: other: shorts. The duty rate will be 7.5 percent ad valorem.

The applicable subheading for the skirt of style SBS-180-95 will be 6204.59.4060, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' suits, ensembles, suit-type jackets and blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): skirts and divided skirts: of other textile materials: other: other.

The applicable subheading for style SBR-18-95 will be 6204.19.8090, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): suits: of other textile materials. The rate of duty will be 7.8 percent ad valorem.

The blouses of styles SBS-180-95 and 9008 fall within textile category designation 840; style SBR-18-95 falls within textile category designation 844; the skirt of style SBS-180-95 falls
within textile category designation 842; the shorts of styles SBS-243-95 and 9008 fall within textile category designation 847 and the jacket of style SBS- 243-95 falls within textile category designation 835. Based upon international textile trade agreements products of China are subject to a visa requirement and quota restraints.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
