RE: The tariff classification of a knit blouse and trouser set from Thailand

Dear Ms. Kline:

In your letter dated April 2, 1996, you requested a tariff classification ruling.

The submitted sample, which will be designated as style LF6 421N or LF6 421I, is a girl's blouse and trouser set constructed from 60% cotton, 40% polyester finely knit jersey fabric that measures more than ten stitches per linear centimeter counted in both the horizontal and vertical directions. The blouse features a full front opening with four button closures, a peter pan collar, gathering at the front and back yokes, long sleeves with elasticized cuffs, a flared body, an applique on the lower left front panel and a straight hemmed bottom. The trousers feature a fully elasticized waistband and hemmed leg openings.

You have stated in your letter that the garments will be sized for newborn and infant girls. If the garments are sized 24 months or under and are designed for young children of a body height not exceeding 86 centimeters, the garments will be classified as babies garments. If the garments are sized 2T and above they will be classified as girl's wearing apparel.

The applicable subheading for the blouse and trouser set, sized 24 months and under, will be 6111.20.6020, Harmonized Tariff Schedule of the United States (HTS), which provides for babies garments and clothing accessories, knitted or crocheted: of cotton: other: other: sets. The rate of duty will be 8.5% ad valorem.

The applicable subheading for the blouse, sized 2T and above, will be 6106.10.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' blouses and shirts, knitted or crocheted: of cotton: girls': other. The rate of duty will be 20.7% ad valorem.

The applicable subheading for the trousers, sized 2T and above, will be 6104.62.2025, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' suits . . . trousers, bib and brace overalls, breeches and shorts: of cotton: other: trousers and breeches: girls': other. The rate of duty will be 16.3% ad valorem.

The blouse and trouser set, sized 24 months and under, falls within textile category designation 239. The blouse, sized 2T and above, falls within textile category designation 339 and the trousers, sized 2T and above, falls within textile category 348. As products of Thailand, this merchandise is subject to a visa requirement and quota restraints based upon international textile trade agreements.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
