RE: The tariff classification of a Multi-Function Ice Scraper from China and Taiwan

Dear Mr. Eisen:

In your letter dated March 27, 1996 you requested a tariff classification ruling.

The item concerned is a triangular, yellow piece of hard plastic with hard, black rubber covering one elongated point of the triangle; at the tip of the elongated point is a yellow, hard plastic valve and on the left edge of the underside of the hard, black rubber covering is a button. The edge of the triangle opposite the valve is formed to a point and has nine hard plastic protrusions above it. In the middle of the pointed edge is a «" rectangular hole with a point-tipped, black and white, hard plastic, sliding Tire Tread Gauge affixed in it's center; the gauge, itself, is visible on the underside of the item. In the middle of the triangle is a piece of clear, magnifying plastic with a circumference of 5«". Bisecting the magnifying plastic on the underside is a black & white, square, hard plastic. sliding pressure gauge.

You state that the purpose of this item is to be used as an automobile windshield/window ice scraper, tire tread gauge and a tire pressure gauge with lighted plastic magnifier.

The applicable subheading for the Multi-Function Ice Scraper will be 8708.99.8080, Harmonized Tariff Schedule of the United States (HTS), which provides for Parts and accessories of . . . motor vehicles . . . : Other parts and accessories: Other: Other: Other: Other: Other. The rate of duty will be 2.9% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
