RE: The tariff classification of a woman's blouse from Hong Kong

Dear Mr. Lynch:

In your letter dated March 19, 1996, you requested a classification ruling on behalf of Susan Bristol, Inc. The sample submitted with your request will be returned to you under separate cover.

Style 14554 is a blouse constructed from 100 percent woven polyester fabric. The short sleeved garment extends from the shoulders to just below the waist. The front and rear panels are lined while the sleeves are not. The blouse has a full front opening secured by six buttons, shoulder pads tacked to the outside of the lining, a non-functional belt located on the back panel and two rear slits measuring approximately 1.5 inches each. In addition, the blouse has several areas of openwork overlay on the front panels. The neckline, sleeves, front opening and bottom of the blouse are trimmed with this edging.

The applicable subheading for the blouse will be 6206.40.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' blouses, shirts and shirt-blouses: of man-made fibers: other: other: other: women's. The duty rate will be 28.3 percent ad valorem.

The blouse falls within textile category designation 641. Based upon international textile trade agreements products of Hong Kong are subject to quota restraints and a visa requirement.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
