Dear Mr. Single:

In your letter dated December 20, 1995, you requested a tariff classification ruling, on behalf of your client, Artmark Products Corp. The subject items are tools for assembling swing sets used in playgrounds. They are made of steel and are described as follows:

2) Model T-45/99-63 - which is a bent shaped hand-operated nonadjustable wrench approximately 5" in length.

3) Model T-30/79-82 - which is similar to the T-45/99-63 model but narrower and approximately 3 1/2" in length.

The applicable subheading for models T-45/99-63 and T-30/79-82 will be 8204.11.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for hand-operated spanners and wrenches, and parts thereof: nonadjustable, and parts thereof: other. The duty rate will be 9% ad valorem.

The duty rate will be 5.4% ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
