RE: The tariff classification of ductile iron flanges and ductile iron handwheels from China.

Dear Mr. Sharma:

In your letter dated January 10, 1996, you requested a tariff classification ruling. Representative photos and drawings of the products to be imported were submitted with your request.

The products to be imported are cast ductile iron flanges and cast ductile iron handwheels. The flanges, which range from 10 to 15 pounds in weight, are drilled and threaded and will be used with ductile iron pipe. The cast iron handwheel is for use on a manually operated valve. These handwheels are considered by Customs to be integral components of the valves that they are used with.

The applicable subheading for the cast ductile iron flanges will be 7307.19.30, Harmonized Tariff Schedule of the United States (HTS), which provides for tube or pipe fittings (for example, couplings, elbows, sleeves), of iron or steel, cast fittings, other, ductile fittings. The rate of duty will be 6 percent ad valorem.

The applicable subheading for the cast iron handwheel will be 8481.90.30, HTS, which provides for parts of hand operated valves, of iron or steel. The rate of duty will be 6.8 percent ad valorem.

Since no country of origin markings were observed on the photos of the cast ductile iron flanges, you should be made aware that all imported pipe and pipe fittings of iron or steel must be permanently marked to indicate the proper country of origin by means of die stamping, cast-in-mold lettering, etching, engraving or paint stenciling.

For your information, there is an antidumping duty order for compact ductile iron waterworks fittings from China. The products covered by case A 570-213 conform to AWWA/ANSI Specification C153/A21.53. The types of fittings covered by this order are compact ductile iron mechanical joint waterworks fittings and compact ductile iron push-on joint waterworks fittings.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
