RE: The tariff classification of a lamp fixture and its components from China.

Dear Mr. Zhu:

In your letter dated December 14, 1995, you requested a tariff classification ruling.

The merchandise at issue, based on the literature submitted, is the "Vented U-Tube" light fixture which consists of the following:
a) a perpendicular-shape ballast;
b) a U-Tube discharge lamp;
c) a polycarbonate globe that is designed to protect the lamp from breakage and shield the ballast and wiring from the environment;
d) a sub-assembly, composed of rugged lexan plastic, that possesses all gaskets, steel screws and mounting feet for ceiling installation.

The applicable subheading for the "Vented U-Tube" lamp fixture will be 9405.40.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for other electric lamps and lighting fittings. The rate of duty will be 3.9 percent ad valorem.

The applicable subheading for the ballast will be 8504.10.0000, HTS, which provides for ballasts for discharge lamps and tubes, and dutiable at the rate of 3 percent ad valorem.

The appropriate subheading for the U-Tube discharge lamp will be 8539.39.00, HTS, which provides for other discharge lamps, with the duty rate of 3.2 percent ad valorem.

The appropriate subheading for the plastic globe and sub-assembly will be 9405.92.0000, HTS, which provides for other lamp parts of plastics, with the duty rate of 4.7 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
