RE: The tariff classification of a chairpad shell China.

Dear Mr. Cole:

In your letter dated December 11, 1995, on behalf of Town and Country Linen Corp., Lakewood, New Jersey, you requested a tariff classification ruling.

The sample submitted is a chairpad shell, item number 4160, made of 65 percent polyester and 35 percent rayon woven fabric and measures approximately 16 1/2 inches long by 18 inches wide with a 13 inches opening at one end. Sewn around three of the sides is a ruffle constructed of the same fabric. The textile binder sewn onto the open end forms a tie strap at each side. After importation the shell will be stuffed and sewn closed.

The applicable subheading for the chairpad shell will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles...Other: Other, other. The rate of duty will be 7 percent ad valorem. The 1996 rate of duty will be the same.

At the present time there are no quota restrictions for articles classifiable under subheading 6307.90.9989, HTS, from China. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
