RE: The tariff classification of a paperboard box, notecards and envelopes from China, and rubber stamp from Taiwan

Dear Mr. Thayer:

In your letter dated November 13, 1995, you requested a tariff classification ruling for an article designated "995ZIS721 Oval Box with Notes, Envelopes and Rubber Stamp Ensemble". A sample ensemble was submitted, which will be returned to you, as requested. It was necessary to break open the shrink-wrapping surrounding the ensemble, in order to examine the individual components.

The article will not be treated for tariff classification purposes as "Goods put up in sets for retail sale", inasmuch as all of the components "are not put up to meet a particular need or carry out a specific activity". Each component will be separately classifiable.

The ensemble contains 10 white standard paper envelopes, about 4 1/2 x 6 3/8 inches, with gummed flaps, suitable for mailing. The applicable subheading for these envelopes will be 4817.10.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for: Envelopes,...of paper. The rate of duty will be 3.6 percent.

It also contains 10 correspondence cards, of a size compatible with the envelopes, which are printed on the outer faces or surfaces, with a floral decorative background, on which, on the front face, a cartoon character named "Ziggy" (c), accompanied by a small dog, is chasing a butterfly. The inner faces are blank.

The applicable subheading for the correspondence cards will be 4817.20.4000, HTS, which provides for: ..correspondence cards, of paper or paperboard, other than a certain described kind of stationery. The rate of duty will be 2.9 percent.

The ensemble includes an oval box of paperboard, with lid,covered on its outer surfaces with printed coated paper. The box is about 2 1/2 inches high, including the lid, and measures about 5 inches in length and 4 inches in width. The applicable subheading for the box will be 4823.90.6500, HTS, which provides for: Other (than certain enumerated) articles of coated paper or paperboard. The rate of duty will be 5 percent.

The last component is a rubber stamp, 2 inches square, 3/4 inch high, by which an image of "Ziggy" (c) may be impressed on paper or other suitable surface. The applicable subheading for the rubber stamp will be 9611.00.0000, HTS, which provides for: Date, sealing or numbering stamps and the like, for operating in the hand. The rate of duty will be 4.8 percent.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
