RE: The tariff classification of the Ski Hoop from Canada

Dear Mr. Smith:

In your letter dated November 15, 1995, you requested a tariff classification ruling.

The merchandise is the Ski Hoop, a storage article. It consists of a 10-inch diameter stainless steel ring attached to a stainless steel backplate. Attached to the ring is a net bag made of polypropylene. The Ski Hoop will be installed on the back of restroom cubicle doors at ski areas where it will serve as a receptacle for hats, gloves, and goggles. The hoop pivots in its backplate, and folds up against the wall when not in use. You indicate that the merchandise is also suitable for general storage use in other locations. In the opinion of this office, the Ski Hoop is of the same class or kind as similar articles used in the home.

The applicable subheading for the Ski Hoop will be 7323.93.0080, Harmonized Tariff Schedule of the United States (HTS), which provides for table, kitchen or other household articles and parts thereof, of iron or steel, other, of stainless steel, other. The rate of duty will be 3.1 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
