RE: The tariff classification of an LCD Module for a Sub-notebook computer from Japan.

Dear Mr. Scott:

In your letter dated October 25, 1995, on behalf of Rikei Corporation of America, you requested a tariff classification ruling.

The merchandise under consideration involves a model LM DA55 32 NTK ultra thin VGA LCD module that is designed and used with a sub-notebook computer.

This LCD module is used in a notebook computer to display images and data information. In its imported condition, it includes the glass sandwich, PCB, row and column drivers, IC's, housing, and backlight. It is specially designed for use in a palmtop/sub-notebook computer and small size portable computer applications. One example for such uses is with the DTR-1 sub-notebook computer from Dauphin, which can run Windows for Pen and other desktop application software.

The power consumption of this computer is 1.69W, including the backlight. The pixel configuration of this unit is 640 x 480, and the dot pitch is from 0.19 x 0.18mm. The module weighs 160 grams, and has a very thin profile. The dimension of this module is 186 mm in width, 121 mm in height, and 5.5 mm in depth.

This LCD module has the special design characteristics that indicates that it is principally used with ADP applications. It also meets the definition of a "unit" of an ADP system, as per Legal Note 5 (B) to Chapter 84.

The applicable subheading for the model LM-DA55-32NTK LCD module will be 8471.92.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for display units, without cathode-ray tube (CRT), having a visual display diagonal not exceeding 30.5 cm. The rate of duty will be free.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
