RE: The tariff classification of a sewing box from China.

Dear Mr. Morton:

In your letter dated October 5, 1995, you requested a classification ruling.

The sample submitted is a sewing box made of cardboard base covered externally and internally with 65 percent polyester/35 percent cotton woven floral fabric. The lid is permanently attached. Attached to the interior of the lid is a textile covered pad that features an open pocket made of plastic sheeting with the top trimmed with woven textile fabric and eight woven narrow fabric loops. The sewing box also contains in its central compartment, a full-sized removable tray constructed of a cardboard base and covered with the same above fabric. The tray is designed to hold various sewing accessories. There is a plastic bag which contain spools of thread, needles, a tape measure, a scissor, and a pin cushion. The sewing box measures 10 1/2 inches long by 7 3/4 inches wide and 4 1/2 inches high.

The applicable subheading for the sewing box will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles...Other: Other, other. The duty rate will be 7 percent ad valorem.

Merchandise which is classifiable per se under subheading 6307.90.9989, HTS, is not subject to visa requirements or quota restraints. However, the sewing thread is not classifiable per se under that subheading. It is only classifiable there by virtue of GRI 3(b); the sewing box imparts the essential character of the entity. Thus, the sewing thread, which is part of the basket's contents, is subject to visa requirements and/or quota restraints under subheading 5508.10.0000, HTS, which provides for sewing thread of man-made staple fibers, whether or not put up for retail sale: Of synthetic staple fibers. It falls within textile category designation 200. As a product of China this merchandise is subject to visa requirements and quota restraints based upon international textile trade agreements.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
