RE: The tariff classification of women's wearing apparel from Hong Kong

Dear Ms. Bhatia:

In your letter dated June 13, 1995, you requested a classification ruling. The samples submitted with your request will be returned to you under separate cover.

Style 659843H consists of two garments: a pullover and a camisole. The pullover is constructed from knitted net fabric that is 100 percent rayon. The pullover features long sleeves, a round neckline and all over beadwork. The second piece is a camisole that is constructed from 100 percent polyester woven fabric. The garment features 1/4 inch wide shoulder straps, a low neckline and a straight hemmed bottom. Both garments extend below the waist and are stitched together at the shoulder seams.

Style 689849H consists of two garments: a dress and a liner. The dress is constructed from knitted net fabric that is 100 percent rayon. The short sleeved dress features a round neckline and all over beadwork. The slip-like liner is constructed from 100 percent polyester woven fabric. The garment features 1/4 inch wide shoulder straps and a scoop neckline. Both garments extend to just below the knee and are stitched together at the shoulder seams.

As noted above each of the submitted samples consist of two separate garments. Although the garments are attached, each garment is complete. The garments comprising each style are tacked at the shoulder and this stitching is not sufficient to affix the garments permanently and can easily be removed without damage to either garment. Accordingly, the samples are each classified as two separate garments.

The applicable subheading for the pullover will be 6110.30.3055, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: women's or girls'. The duty rate will be 34 percent ad valorem.

The applicable subheading for the camisole will be 6211.43.0091, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women's or girls': of man-made fibers: other. The duty rate will be 16.9 percent ad valorem.

The applicable subheading for the dress will be 6104.44.2010, Harmonized Tariff schedule of the United States (HTS), which provides for women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear), knitted or crocheted: dresses: of artificial fibers: other: women's. The duty rate will be 16.8 percent ad valorem.

The applicable subheading for the slip-like liner will be 6208.92.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' singlets and other undershirts, slips, petticoats, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressing gowns and similar articles: other: of man-made fibers: other: women's. The duty rate will be 16.9 percent ad valorem.

The pullover falls within textile category designation 639; the camisole falls within category 659; the dress falls within category 636 and the liner falls within category 652. Based upon international textile trade agreements products of Hong Kong are subject to a visa requirement and quota restraints.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
