RE: The tariff classification of electric power network monitoring equipment from Canada

Dear Ms. Ellman:

In your letter dated July 11, 1994, you requested a tariff classification ruling on behalf of Jomitek Inc.

All of the equipment will be used to monitor the performance of electric power networks. It will be imported as individual units or in groups (not considered to be sets by Customs) consisting of one or more of the various units. The items you inquired about are: an energy transducer, ET V 4.4; a pulse transducer, PT V 1.0; a weather station, WS V 3.1; an input/output module; and a computer interface box.

The applicable subheading for the energy transducer will be 9030.39.0080, Harmonized Tariff Schedule of the United States (HTS), which provides for other instruments and apparatus, for measuring or checking voltage, current, resistance or power, other. The general rate of duty will be 4.9 percent ad valorem.

The applicable subheading for the pulse transducer will be 9032.90.6080, HTS, which provides for automatic regulating or controlling instruments and apparatus, parts and accessories, other. The general rate of duty will be 4.9 percent ad valorem.

The applicable subheading for the weather station will be 9015.80.8080, HTS, which provides for other meteorological instruments and appliances, other. The general rate of duty will be 4.9 percent ad valorem.

The applicable subheading for the input/output module and the computer interface box will be 8537.10.9070, HTS, which provides for boards, panels, ... for electric control or the distribution of electricty, ... not exceeding 1,000 V, other. The general rate of duty will be 5.3 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
