RE: The tariff classification of Tertiary Butyl Alcohol mixture from the United Kingdom.

Dear Mr. Sherman:

In your letter dated November 3, 1994, on behalf of your client Vitol S.A., Inc., you requested a tariff classification ruling for tertiary butyl alcohol mixture which is an additive for mineral oils. The importer has stated that this product is used as an antiknock preparation (an octane enhancer) or to a lesser extent as a source of an oxygenate.

The applicable subheading will be 3811.19.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for antiknock preparations, oxidation inhibitors, gum inhibitors, viscosity improvers, anticorrosive preparations and other prepared additives, for mineral oils (including gasoline) or for other liquids used for the same purposes as mineral oils: antiknock preparations: other. The rate of duty will be 3.7 cents per kilogram plus 13.6 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
