RE: The tariff classification of a "white moulding" from Ireland

Dear Ms. Crawford:

In your letters dated July 22, 1993 and August 12, 1993, on behalf of Puratos, Inc., Cherry Hill, NJ, you requested a tariff classification ruling.

An ingredients breakdown was submitted with your first letter. The product is said to be composed of 55.6 percent sugar, 32.2 percent vegetable oil, 11.7 percent whey, and less than one percent each of lecithin and vanillin. The merchandise will be imported in flake form, packed in 10-kilogram poly-lined boxes, and used in the bakery industry, after melting, as a coating for pastries or cakes.

The applicable subheading for the white moulding material will be 1901.90.8070, Harmonized Tariff Schedule of the United States (HTS), which provides for food preparations of goods of headings 0401 to 0404...other... other...other. The rate of duty will be 10 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
