DATE OF INQUIRY : March 16, 1993

MERCHANDISE : The submitted sample consists of a molded plastic game piece shaped like a blimp, measuring approximately five inches in length. The unit is considered a game machine for tariff classification purposes.

HTS PROVISION : Games machines, other than coin or token operated.

HTS SUBHEADING : 9504.90.4000

RATE OF DUTY : 3.9 percent ad valorem.

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
