RE: The tariff classification of garlands from India.

Dear Ms. Rainbow:

In your letter dated April 13, 1993, you requested a classification ruling.

The samples submitted are garlands, style numbers K-056 and GA-2. Style number K-056 is a 9 foot long decorative braided cord made of 60 percent rayon, 30 percent cotton and 10 percent lurex that is twisted to form a rope with tassels at each end.

Style number GA-2 is a 25 foot long ribbon garland composed of 80 percent rayon and 20 percent lurex woven fabric with a wire inserted into the hems running lengthwise along the edges.

The samples will be returned as requested.

The applicable subheading for Style number K-056 will be 6307.90.4020, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles...Other: Cords and tassels, other. The rate of duty will be 7.2 percent ad valorem.

The applicable subheading for Style number GA-2 will be 5806.32.1090, HTS, which provides for narrow woven fabrics, other than goods of heading 5807;...Other woven fabrics: Of man-made fibers: Ribbons, other. The rate of duty will be 9 percent ad valorem.

Style number K-056 falls within textile category designation 669 and style number GA-2 falls within textile category designation 229. Based upon international textile trade agreements, products of India are subject to quota and visa requirements.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S.
Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
