RE: The tariff classification of various textile articles from China.

Dear Mr. Otrompke:

In your letter dated May 4, 1992, you requested a tariff classification ruling.

The following samples were submitted:

1. Style #8341, described as a "Mesh Laundry Bag", is a general purpose duffel-style drawstring bag designed for travel, sports, laundry, etc. It is composed of knit mesh nylon fabric, and measures approximately 37" x 22 5/8".

2. Style #8051, "Lint Trap", is constructed of nylon open-work raschel knit fabric and measures approximately 8 1/2" x 3" with an elastic band sewn onto the open top.

3. Style #8046, "Sweater Washing Machine Bag", is made of nylon open-work raschel knit nylon fabric. The bag measures approximately 22 1/4" x 17 9/16" and has a zipper across the top of the bag.

4. Style #8047, decribed as a "Laundry Bag", is a general purpose duffel-style drawstring bag designed for travel, sports, laundry, etc. The bag is composed of nylon woven fabric. It is unlined and measures approximately 32 5/8" x 21 7/8".

5. Style #8048, "Cloth Pin Bag", is composed of 65 percent ramie and 35 percent cotton woven fabric. It is unlined and designed with a plastic hanger to be hung on the clothes line. It measures approximately 14 13/16" x 10 3/4".

6. Style #8049, "Lingerie Bag", is made of 100 percent nylon open-work raschel knit fabric and measures approximately 17 11/16" x 14 9/16". It has a zipper closure.

7. Style #8051, "Nylon Puff", is constructed of 100 percent nylon tubular open-work fabric. The item is stitched horizontally down the middle and rolled up in a ball-like fashion. It is held together by a rubberband.

8. Style 6209-A, "Mesh Scrubber", is made of a foam plastic covered with 100 percent nylon open- work raschel knit fabric.

9. Style 6209-B, "Square Terry Mesh Scrubber, is composed of a foam plastic covered with a 100 percent nylon open-work raschel knit fabric on one side and 100 percent terry cloth fabric on the other.

The applicable subheading for the styles #8341, and #8047, the duffel-style travel bags, will be 4202.92.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of textile materials, other, of made-made fibers, other. The rate of duty will be 20 percent ad valorem.

The applicable subheading for styles #8051, #8046, #8048, #8049, #8051, #6209-A, and #6209-B, will be 6307.90.9480, HTS, which provides for other made up articles...Other: Other: Other, other. The rate of duty will be 7 percent ad valorem.

Items classifiable under 4202.92.3030 fall within textile category designation 670. Based upon international textile trade agreements, products of China are subject to visa requirements and quota restraints.

The designated textile and apparel category may be subdivided into parts. If so, visa quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
