RE: The tariff classification of women's blouses from Hong Kong.

Dear Mr. Fritz:

In your letter dated April 27, 1990, resubmitted on June 11, 1990, but not received until June 20, 1990, on behalf of your client, Sideffects Inc., you requested a tariff classification ruling.

The submitted samples, style numbers N170 and N171, are women's pullover blouses which are cut and sewn from knit and woven fabrics. The knit fabric component for both styles is composed of 55% ramie and 45% cotton, and the woven fabric component for both styles is composed of 60% polyester and 40% rayon. Specification sheets submitted with your ruling request indicate that the woven fabric component of style N170 occupies 89.5% of the garment's visible surface area, while the woven fabric component of style N171 occupies 63% of the garment's visible surface area.

Style N170 has three-quarter-length sleeves with single- button, turned-up cuffs; a partial frontal opening, with a placket secured by two buttons; a notched collar; a V-shaped neckline; small lapels; a shoulder yoke; free-hanging yokes on the front and back (in addition to the shoulder yoke) which extend downward to the vicinity of the waist; shoulder pads; and a ribbed waistband. The blouse also features decorative piping extending down each side of the placket and across the horizontal seams of the shoulder yoke; and a welt pocket, inset on the left side of the front yoke, in which is found a detachable, decorative handkerchief. The handkerchief is square-shaped, measuring approximately 7 1/2" on each side, and is hemstitched on all four sides. It is constructed from woven fabric with a polka dot print, which is identical in all respects to the fabric used for the placket, lapels, sleeve cuffs, and the shoulder yoke. The free-hanging front and rear yokes are also printed with polka dots.
The rear panel, sleeves (including the cuffs), shoulder yoke, collar, placket, and the lapels are constructed from woven fabric. The front and rear yokes and the two upper-front panels, which are completely concealed by the yoke, are also constructed from woven fabric. The lower-front (visible) panel and the waistband are con-structed from knit fabric.

Style N171 has three-quarter-length sleeves with ribbed cuffs; a surplice front, with a partial opening secured by a snap fastener; a notched collar; lapels, printed with polka dots; shoulder pads; and a ribbed waistband. The garment also has a rear shoulder yoke, printed with polka dots; and an embroidered, textile overlay bordering the two center panels (also printed with polka dots) on the front and the rear shoulder yoke. The two center panels on the front approximate the shape of a "V".

The entire rear panel of the garment (which includes the rear surfaces of the sleeves), the two center panels on the front, the collar, and the lapels are constructed from woven fabric. The left-front and right-front panels (which include the front surfaces of the sleeves), the waistband, and the cuffs are constructed from knit fabric.

The samples which you have submitted with your inquiry are being returned under separate cover.

The applicable subheading for style number N170, with its accompanying handkerchief, and style number N171, will be 6211.43.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments, women's or girls', of man-made fibers: blouses, shirts and shirt-blouses excluded from 6206. The rate of duty will be 17 percent ad valorem.

With respect to style number N170, the blouse falls within textile category designation 641, and the handkerchief, from subheading 6213.90.1000, HTS, falls within textile category designation 630. Garments and clothing accessories entered as components of sets require separate statistical reporting for textile restraint purposes, pursuant to the Committee for the Implementation of Textile Agreements' directive of December 23, 1988, amended on August 23, 1989. Style number N171 falls within textile category designation 641. Based upon international textile trade agreements, products of Hong Kong are subject to a visa requirement.
The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
