Article Abstract:

A forthcoming UK legal case offers a test case for an appeal against a previous ruling on Special Hours Certificates for licensed pub premises. Mr Justice Owen, ruling on the Marsden case, said that a Chief Constable may wish to prevent particular circumstances through the issuing of Special Hours Certificates. However, he did not state that licensing committees should impose a start time. The case which is pending relates to the licensing committee in Cannock which had been happy to re-grant a Special Hours Certificate under previous terms until the issue of the Marsden case was raised.

UK employees' rights are set down in a European Court ruling of 1981, the Transfer of Undertakings (TUPE), which ensures employees are given the same job rights if a company changes ownership or status. The ruling applies to workers who have been in the same job for over two years. Many companies flout TUPE and redundancy payments, in an attempt to reduce costs and force employees into early retirement. Employees have the law on their side and employers should not resort to bullying tactics to force workers out. The way management handles these issues has an impact on the whole company.

The impact of the De-regulation (Sunday Dancing and Licensing) Order 2000, on Sunday observance is likely to be immediate with both Christmas and New Year falling on Sunday this year. In the event that De-regulation is delayed on its way through Parliament Licensees should be prepared to apply for variations of hours themselves this year.
