Semco Salvage and Marine has filed an appeal with the UK House of Lords seeking clarification for the term 'fair rate' as applies to compensation for salvage equipment used to prevent or reduce pollution caused by a stricken vessel. The clarification request resulted from disputes arising from Semco Salvage's calculation of compensation for assisting an oil tanker which collided with a container vessel in the Malacca Strait on Sep. 20, 1992. During its initial computation, Semco included an element of profit in assessing the oil tanker owner's liabilities. The owner argued that the profit element should not have been included in the calculation.

Cory Towage has been severely criticized for its apparent poor handling of the Sea Empress salvage operation. However, Cory Towage officials pointed out that the difficulties of the operation was beyond the company's control. The Sea Empress had ran aground near Milford Haven, Wales, and its bow was severely torn up, making it difficult to tow it out to sea. The advent of a strong gale forced Cory Towage to turn the Sea Empress's bow to the brunt of the winds. The turning operation proved more difficult since the vessel's anchors failed to retract and Cory Towage's tugs had a hard time positioning themselves around the Sea Empress.
