The Americans with Disabilities Act after Bragdon v. Abbott: HIV infection, other disabilities, and access to care

Article Abstract:

The US Supreme Court ruled in Bragdon v. Abbott that that discriminating against HIV infection patients is an Americans with Disabilities Act (ADA) violation. Employers and healthcare providers must in the future justify the denial of a service or of employment based on individual analysis of the risk an individual poses. Objective scientific evidence must support judgments of risk.

Invisible victims; violence against persons with developmental disabilities

Article Abstract:

The argument that developmentally disabled people become victims of crime in disproportionate numbers is made. The desire for acceptance often leads such people to accept advances they do not want for fear of losing social contact. New laws must be passed to give the developmentally disabled distinctive legal protections from abuse.

Ensuring access to the legal system for children and youth with disabilities in special education disputes

Article Abstract:

The claim that more is needed after the Individuals with Disabilities Education Act in assuring handicapped children an acceptable public education is argued. States should be held accountable for the poor educational outcomes of such children and the IDEA amended to clarify possible damages for IDEA rights.
