The value of a mortgage

Article Abstract:

A case heard in the English courts, during 1999, involved Europe Mortgage Co. Ltd who were claiming the valuer, GA Property Services Ltd, made an incorrect valuation of a property. The valuer had valued the house at 1.65 million pounds sterling, in Jun 1991, but it was later determined the property was actually worth only 1.1 million pounds sterling. The judge decided the loss experienced by the mortgage lender was due to how it organised its accounting procedures and not the actual value of house. The judge pointed out the valuation was made to provide security for the loan.

Challenging the experts

Article Abstract:

Cases brought against valuers acting as independent experts in the rent review process have yet to be found guilty of negligence in a British court of law. A decision made by the independent expert often leads to one side or the other feeling they have not been treated fairly. In a case between Currys Group PLC versus Martin 1999 the judge preferred to take the view the valuation of a rent would include a margin of error. Landlords or tenants have to resort to charging valuers with negligence if they are unhappy over the experts' determinations.
