The UK Labour Government have issued a circular detailing its planning policies, which will be useful for those involved in the making planning applications and the planning authorities. The new guidelines set out planning enforcement provisions and provides local planning departments with clear instructions how to deal with breaches in planning. People who breach planning laws will be issued with enforcement notices which are no longer valid once they are withdrawn. Applicants may be fined sums of up to 20,000 pounds sterling, if they fail to comply with an enforcement notice.

The influence of the courts

Article Abstract:

The courts can have a considerable influence on the operation of the planning system in the UK in instances where a consistent approach is taken to passing judgements in a number of cases dealing with the same point. Over recent years, for example, there has been a succession of cases dealing with the scope and adequacy of reasons given in decision letters from the secretary of state for the environment. Other rulings have provided guidance on when the courts are likely to intervene in the planning process.

Mixed bag of new controls

Article Abstract:

There is a general trend towards deregulation in many areas of business in the UK, but this is not the case with the planning system, where new controls are being introduced and existing controls made stricter. For example, the government is now looking at plans for strengthening conservation area planning controls. Under new regulations, local authorities would obtain greater powers to control the actions of householders in conservation areas.
