A simple guide to tenure

Article Abstract:

When deciding if a UK tenant has a secure tenure the date of the initial agreement between landlord and tenant will be relevant. The Housing Act 1988 is the current act for 1999 but some agreements will still be covered by the Rent Act 1977 and the Housing Act 1996. The Housing Act 1998 was implemented on Jan. 15, 1989. Tenants who were given protection under the Rent Act 1997 can keep the same level of protection and are considered to have a regulated tenancy. Their tenancy may be passed on to their successors. Tenancies under the Housing Act 1998 are either assured shorthold or assured tenancies.

Remedies for rent default

Article Abstract:

A surveyor will have to judge why a commercial tenant cannot pay rent on a property and decided if restructuring of rents and arrears may be applicable or if more drastic action, such as repossession, is necessary. Landlords can use a variety of methods to help prevent arrears occurring, such as obtaining a bond from the tenant when they sign the lease, having guarantors and ensuring rent arrears are not allowed to get too high. The lease can be forfeited if a forfeiture clause is in the landlord and tenant contract but the right to distrain can be used immediately, once there are rent arrears.
