Time Warner is reluctant to conform to regulators' demands to make its news and entertainment content available to America Online (AOL)'s rivals as a condition for approving their merger. They are prepared to defend in court what they believe to be their sacrosanct right to do as they please with Time Warner's trove of movies, music, magazines and TV programming. The impasse could derail the merger deal between the two firms. The Federal Trade Commission is preparing to file a lawsuit against Time Warner and AOL to block the deal if it does not get a package of concessions to preserve competition.

The FCC may prohibit cable TV companies from blocking triggers that enable interactive TV, which allows viewers to click an icon on their TV screens to participate in a game show, talk with friends or buy consumer goods. The proposed regulation may go beyond the constraints imposed by the FTC as a condition for approving the merger between America Online and Time Warner. However, the National Cable Television Assn is opposing the FCC's plan, saying that it is premature to regulate a market that does not exist.

Americal Online Inc, the nation's leading Internet service provider (ISP), plans to transform its primary Web site, AOL.com, from a portal to a control center that offer subscribers capability to access and customize their content. The company will also unveil AOL by Phone, which allow its 25 million members to check their e-mail, news and other features using voice command from any telephone, and its AOL 6.0 software. The ISP will disclose its plans at Internet World in New York, NY.
