Time Warner is reluctant to conform to regulators' demands to make its news and entertainment content available to America Online (AOL)'s rivals as a condition for approving their merger. They are prepared to defend in court what they believe to be their sacrosanct right to do as they please with Time Warner's trove of movies, music, magazines and TV programming. The impasse could derail the merger deal between the two firms. The Federal Trade Commission is preparing to file a lawsuit against Time Warner and AOL to block the deal if it does not get a package of concessions to preserve competition.

The Federal Communications Commission has delayed the final approval of America Online (AOL)'s merger with Time Warner. The reason for the delay is over whether to open AOL's instant messaging to rivals. Democrat Gloria Tristani feels that AOL should be compelled to allow userrs of its dominant instant messaging service to chat with those using similar services. On the other hand, Republican commissioners Michael Powell and Harold Furchgott-Rott feel that the linkup does not affect instant messaging and want an approval of the merger without conditions on the service.
