Court allows disclosure of portions of criminal investigative reports

Article Abstract:

The South Carolina Supreme Court has ruled that the state's law enforcement division violated the state's Freedom of Information Act by not separating out exempt materials from a criminal investigative report and making them available upon request. The division had argued that disclosure of the report would violate the privacy rights of informants, but the court stated that reports could be edited to protect informants. The court also stated that the law requires exempt and non-exempt materials be separated in regard to criminal investigative information.
