In the case of Perlman v. Department of Justice, the US Court of Appeals for the 2d Circuit ruled that New York city attorney Steven Perlman must be given information about a former Immigration and Naturalization Service counsel. Perlman is investigating an INS program that helped wealthy foreign investors gain US visas. The INS had sought to protect the former counsel's privacy by withholding some information sought by Perlman.

Jonathan Randel, an employee of the Drug Enforcement Agency, pleaded guilty to a charge of selling government property for leaking non-classified information to a British newspaper. Government officials may also be planning to try to bring indictments against the newspaper, The Times of London, for receiveing and paying for the information.

The Homeland Security Act of 2002 makes it a crime to leak critical infrastructure that has been provided to government by businesses. This applies even if the information is not classified. Several states are considering passing several laws in relation to state government information.
