The existing laws of patenting of genetic material compositions in Australia are examined. The tailored pro-competition laws in the Patents Act and the Trade Practices Act are to be applied for promotion of innovation and restriction of anti-competitive conduct by genetic material patent holders.

The Australian Trade Practices Act (TPA) is reviewed and the ways in which competition law addresses market division for the purpose of discriminatory pricing is examined. The mechanisms necessary for preventing arbitrage in price discrimination are discussed.
