Lawyers who represent multiple clients in a single case should make some changes in their standard engagement letters and include policies regarding joint and separate meetings of cients, the lawyer's duty to keep each client advised of the communications of the others, whether each client is jointly and severally liable for all fees and costs, and conflict considerations. Identify each potential problem and how disagreements will be dealt with.

The point when a present client becomes a former client is key in terms of conflicts of interest, and since an attorney can represent a client whose interests are adverse to the former clients as long as the legal matters are not "substantially related," in the words of Model Rule of Professional Conduct 1.9.Lawyers should send letters of termination as a sign that a legal relationship is over.
