Issues concerning the trend among telecommunications companies to co-locate on other carriers' towers and the use of subleases as a vehicle to manage this transaction. The sublease structure may be the best choice for mitigating bankruptcy risk and make possible the sharing of network assets.

Article Abstract:

The 9th Circuit's ruling in Ets-Hokin v. Sky Spirits, Inc., on the copyrightability of commercial photography is discussed. The uncopyrightability holding of the lower court was reversed and the photographs were found to be original works of authorship rather than derivative works.
