Visitation, alleged abuse are a potent mix

Article Abstract:

The problem of the courts position in instances of alleged abuse by parents with limited visitation privileges is central to a growing number of cases. A Kentucky case of alleged sexual abuse of a six-year old has ballooned into cases by the plaintiff Christy Halloran against the judge, Larry D. Raikes of the Hardin Circuit Court, and the prosecutor James Ladd. The difficulty of these cases lies in determining if actual abuse occurred or the suit is merely vengeance.

Pregnant drug abusers sue for treatment

Article Abstract:

Women's rights activists have been successful in defeating attempted child abuse prosecutions of drug-addicted pregnant women and are now turning their attention to forcing drug treatment programs to help substance abusers. These activists claim that many programs refuse to accept pregnant women and are trying to compile quantitative evidence of this fact. States are also being pressured to use more federal grant money to treat pregnant drug addicts.

Split rulings for fetal abuse cases

Article Abstract:

A Kentucky appellate court's reversal of a woman's 'prenatal child abuse' conviction is the latest development on this controversial topic. Several other trial and appellate courts have overturned similar cases involving drug abuse by pregnant mothers. Some states have attempted to expand statutory definitions of child abuse to include maternal drug abuse, and seven states have sought to legislate penalties for such behavior.
