Reflexions sur l'expertise-arbitrage en droit suisse

Article Abstract:

The Geneva Court of First Instance dismissed a motion of appointing an expert for various corporate transactions and hence gave rise to a question of whether judicial assistance should be available, much like in arbitration or not. It is indicated that considering the Geneva Court decision, as well as the case law of the Swiss Federal Supreme court, there is an appropriate need of a judicial assistance that depends on the circumstances and hence should be available whenever required.

Article Abstract:

Certain issues pertaining to the New York Convention, in particular the effect of two arbitral awards among the same parties was addressed in the Swiss Federal Supreme Court's decision of 3 January 2006. A particularity of Swiss labor law are collective employment contracts, which are standard conditions applicable to certain industries that are negotiated between the workers' union and the employers' representatives.

Article Abstract:

A consortium of construction companies initiated arbitration against CERN in 1986, which was based on an arbitration clause in CERN's general conditions of contract, in the Swiss Federal Supreme Court. A discussion of the jurisprudence of the case, by the Switzerland court is discussed.
