Article Abstract:
Courtroom battles over whether using Napster and similar applications for free downloading of music and other content from the Internet constitutes a violation of the fair use doctrine in copyright law are discussed. Universal City Studios v. Reimerdes, a case with First Amendment implications challenging the publishing of computer code permitting the illegal copying a movie DVDs, is also discussed.

Issues are discussed regarding the fairness in applying the death penalty in the 38 states, as well as the federal and military courts, which use capital punishment. Death penalty statutes, policies for their application, and prosecutors' views of how much influence victim impact statements should have, vary considerably among the jurisdictions.

Article Abstract:
Many state and federal courts have already cited the Restatement (Third) of the Law Governing Lawyers in their opinions, even though it is not finished yet and has been in development for more than a decade. The balkanization of conduct rules in the 50 states prompted the American Law Institute to undertake the restatement project.The confidentiality provisions of the restatement have come in for much criticism by detractors.
