Article Abstract:

A history of the FTC's stance on corporate divestitures followed by some of the changes the merger process has undergone is given. The agency increasingly requires that a remedy completely eliminate all increased concentration from a merger. Divestitures deals should be structured so that there are no continuing ties to the buyer.

The globalization of antitrust law is discussed , with the substantive convergence of EU and American merger law and merger remedies as an example. Factors which the EU plans to consider in developing an effective merger remedy, many based on FTC procedures, are summarized.
