The American College of Forensic Examiners (ACFE), a nonprofit organization that credentials forensic experts, is described as issuing "checkbook credentials." Many ACFE critics fear that judges will assume a prospective witness with ACFE certification is qualified to testify as an expert, even if this is not the case. Tips for lawyers looking for an expert are listed.

Experts are liable, too

Article Abstract:

The new tort of expert witness malpractice and the increase in suits against expert witnesses are discussed. Of the seven states in which suits against friendly experts have been filed, only Louisiana and Washington have held these experts to be immune. Ways experts can avoid suits for malpractice are listed.

Admissions tests; fewer post-Daubert federal judges allow experts to testify without limitation in civil trials, study finds

Article Abstract:

Findings that exclusions of expert evidence by federal judges have grown more likely in civil cases than they were a decade ago are discussed. This reluctance has resulted from Kumho Tire Co v. Carmichael and two other Supreme Court rulings on the admissibility of scientific evidence.
