A bold new awakening? The new Taiwanese Copyright Law

Article Abstract:

Taiwan's Copyright Law was updated in 1992 to strengthen enforcement and foster international harmony. Foreign provisions include entitlement of US works, recognition of US copyrights and entitlement of works by other foreigners if published in Taiwan within 30 days of foreign publication. Other provisions include author rights, plate rights, assignment, licensing, compulsory licensing and no registration requirement. Works covered include print, music, art, drama, dance, visual, audiovisual, architecture, recordings and computer programs.

Article Abstract:

Taiwan's 1992 Copyright Law is presented in English translation. The new law is intended to strengthen enforcement and promote international harmony, with broader coverage. Its chapters cover general principles, works and authors, copyright, plate rights, intermediary associations and review and mediation committees, remedies for infringement of rights, penal provisions and supplementary provisions. Works covered include print, music, drama, dance, art, photography, pictures, audiovisual, recordings, architecture and computer programs.

When law, science and technology worlds collide: copyright issues on the Internet

Article Abstract:

Increasing use of the Internet requires greater clarity on how copyright law applies to it. Copyright law gives holders the exclusive right to display copyrighted materials. Infringement can be proven under direct, contributory or vicarious theories. Cases involving Internet Service Providers and Bulletin Board Services suggest that liability is likeliest to be proven under the contributory theory. Congress must provide the courts with more instruction on applying the Copyright Act to the Internet.
