Due to limited guidance by the IRS as to what determines partial termination within a company, the Seventh Circuit of Appeals rendered a decision in a case involving Household International Inc. The case involved Robert Matz, laid off when the company eliminated the division in which he worked. As a result, his employee retirement benefits were jeopardized.

The U.S Supreme Court has ruled that decisions made by administrators of ERISA regulated benefit plans could be challenged by the exclusive remedy that ERISA provides. This ability to launch challenges could protect employers and managed care entities from state-based lawsuits. The Court's ruling is discussed in detail.
