Environmental liability insurance remains an underdeveloped market that is dominated by a few large insurance companies. A.M. Best Co reports that the environmental liability insurance market has not broadened, yet some smaller insurers are making inroads in the market by emphasizing niche marketing. A minimum of 10 insurers have entered the field since 1995; many of these companies have connections with large insurers. These small companies have pioneered innovative environmental liability insurance coverages.

Article Abstract:
The new guidelines on workplace safety and violence prevention from the Occupational Safety and Health Administration provide new opportunities for insurance companies to provide coverage for the risks of violence. Although the guidelines are not laws, companies could be sued if the plaintiff can prove the company negligent in adapting itself to known dangers in the workplace. Insurers are unsure of the benefits of writing policies which would insure companies against lawsuits.

New York, Florida and other states are taking small steps toward laws modeled on Colorado's regulation of the auto insurance sector which allows managed care for injuries and other cost-containment measures. Personal injury protection policies regulated by managed care can only be implemented in states where evidence of fraud is present and insurance is mandatory. The success of the Colorado program is analysed.
